The High Court’s annulment of the €300,000 fine imposed on Airbnb for advertising illegal Tourist accommodation in the Balearic Islands has been met with anger and disbelief from environmentalists, neighbourhood associations and other homestay platforms.

The ruling opens the way for other Tourist Rental websites such as Homeaway to have appeals granted. Department of Tourism lawyers will be analysing the small print to ensure that doesn’t happen.

Unlicensed and unregistered tourist properties cannot legally be marketed, but Airbnb has been described as knowing the legal loopholes and how to benefit from them.
